Pet food recall: Menu sues ChemNutra – and yes, there’s another recall

Looks like Menu is placing the blame for the contamination of pet food that led to the massive ongoing pet food recall squarely on ChemNutra, the company that sold the pet food manufacturer wheat gluten contaminated with melamine.

And the Canadian company is doing it the American way: with a lawsuit.

From the Emporia Gazette, in Emporia, KS, where the plant that received the contaminated ingredient is located:

“Menu Foods prides itself on providing customers with wet pet food products made with high quality ingredients,” the company’s attorneys stated in the court petition, filed in Lyon County District Court. “In 2006, ChemNutra promised Menu Foods that it could supply one such high quality ingredient, wheat gluten to Menu Foods. ChemNutra breached its promise.”

The gluten came to ChemNutra from a Chinese supplier.

At Congressional hearings earlier this week, Menu Foods President Paul Henderson said the gluten may have been spiked as part of a fraud. Melamine is high in nitrogen, he said, and could make wheat gluten appear to be high in protein.

“What this appears to be is a case of deliberate contamination of wheat gluten in order to pass off substandard product,” Henderson told a U.S. House committee. “For a seller who knows how industry testing methods work, this would allow them to cheat the buyers.”

ChemNutra Chief Executive Officer Steve Miller, in a letter on the company’s Web site, said he feared his own company had been “the victim of deliberate and mercenary contamination” as well. He said the Chinese company that sold the gluten had been recommended to ChemNutra by a reliable source.

“We assure you that we will never again do business with the supplier of the suspect wheat gluten, XuZhou Anying Biologic Technology Development Co., Ltd.,” Miller wrote. “…We hope that U.S. and Chinese investigations of XuZhou Anying reveal what actually occurred.”

In the lawsuit, Menu Foods asks for a judgment “substantially in excess of $75,000.” It also asks that ChemNutra indemnify Menu against all costs associated with the recall and any lawsuits pressed against Menu as a result of the recall, along with any other damages the court chooses to assign.

UPDATE: So far unconfirmed, but from a flood of email from readers, there may be another recall – Therese from thepetfoodlist.com and I are digging into it now.

UPDATE 2: I found it on the PetSmart press center website. It is an extended list of recalled products carried by PetSmart, that includes several Blue Buffalo foods, dated as having been added today.

These products are NOT referenced on Blue Buffalo’s own website, which still states that only its one run of one kitten food was affected by the recall.

Update 3:Itchmo just got a press release from Blue Buffalo, which he has reproduced in its entirety here. Excerpt:

We at the Blue Buffalo Company have just learned that American Nutrition Inc. (ANI), the manufacturer of all our cans and biscuits, has been adding rice protein concentrate to our can formulas without our knowledge and without our approval. This is product tampering, and it apparently has been going on for some time. The can formulas that we developed, and trusted them to produce, never contained any rice protein concentrate. It appears that only an FDA investigation of ANI’s rice protein concentrate supplies forced them to reveal this product tampering to us.

While this activity by ANI is in itself unlawful, the situation is further clouded by the fact that ANI has been receiving rice protein concentrate from Wilber-Ellis, some of which the FDA has determined to be contaminated with melamine.

So while no BLUE or Spa Select canned product has tested positive for the presence of melamine, and there has been no reported illness due to any of our canned products, we simply cannot be sure of what ANI has been including in our formulas. For this reason, we have decided to remove all of our canned and biscuit products from retail distribution. While this may seem to many to be a major over-reaction, as other ANI customers will probably only recall the products that tested positive for melamine, we see this as a matter of integrity.

Update 4:And forwarded from itchmo, a press release from ChemNutra – seems the FDA searched ChemNutra’s office today. And since Menu’s suing ChemNutra, ChemNutra is doing some finger pointing of its own:

Steve Miller, Chief Executive Officer of ChemNutra, said “We have cooperated and complied fully with FDA investigators both prior to and since being served with today’s search warrant, and will continue to do so. We keep very good records which has made it relatively easy for the investigators to retrieve what they needed.” He added that, “We also now believe that our wheat gluten customer, Menu Foods, used significantly more wheat gluten monthly than we supplied to them, so we hope that Menu Foods will disclose its other sources to the FDA to ensure that any suspect product is quarantined.

“We placed our wheat gluten in quarantine as soon as Menu Foods informed us that it might have contributed to pet illnesses about which Menu Foods had apparently been aware for some time. We can only hope that Menu Foods has taken steps to ensure that this situation will not be allowed to spread even farther because of its inaction.”

  6. Obviously, ChemNutra shares the liability; however, Menu Foods is a lot more guilty.

    Menu Foods delayed the recall. They failed to test their products. They ignored the reports of pets becoming ill or dying after eating their product. They contined to operate after the death of their own test animals. An officer sold 45% of his stock before issuing the recall.

    The recall was issued only after IAMS tested their product and threatened to do the recall themselves.

    THE MENU FOODS PEOPLE BELONG IN JAIL.

  16. I work at a popular pet food store and am privy to information prior to official announcements. We were told to pull a bunch of Blue Buffalo products off the shelf before opening tomorrow due to additional recall. I emailed Petconnection with all of the products but they said they have to verify before thay can post. I am not sure how thay will be able to verify. the official news will probably come out tomorrow but I wanted to get the word out there asap.

    I am sorry if there are any spelling or grammer errors it’s late and I’ve been crying because I just fed my dogs and have been feeding my dogs the food that is now recalled. I really thought Blue Buffalo was a safe choice. The canned food has such great ingredients listed. Who can we trust? I will start making my own food tomorrow.

    Update as of April 26, 2007
    Blue Buffalo extended its recall to include wet dog and cat food and some dog biscuit products upon finding that potentially contaminated rice protein concentrate (rice gluten) was used in the production of these products. According to the company, no Blue Buffalo or Spa Select canned products have tested positive for the presence of melamine. However, they’ve decided to remove all of their canned and biscuit products from retail distribution. The expanded recall affects 17 Blue Buffalo products carried at PetSmart. We’ve pulled these products from our store shelves regardless of production dates. Here’s the complete list of products carried by PetSmart that are part of the recall, which includes the updated information.

  23. Keep Questioning Everything!!!!!

    The FDA may never know how many pets have died and become ill from this DISASTER?

    If they are not intending to investigate the calls they get from pet owners and veterinarians, how are we going to know the extent of deaths and illnesses from tainted pet food?

    This is OUTRAGEOUSLY UNACCEPTABLE!!!!!!!!!!!!!!

    We need Congress to intervene to change it.

    Don’t forget to send your postcards.

    And with the contaminated hogs (possibly chickens and I wouln’t rule out cattle), what is the role of the USDA in all of this?

    I thought that pets were the lowest form on the AAFCO foodchain, how did leftovers from pet food companies end up in pig feed?

    I want to get the information accurate.

    Like I said before, KEEP ASKING QUESTIONS!!!!!
    Ask questions of the FDA, USDA, members of Congress, the President, the Pet Food Companies, the media, and anyone else in the chain.

    We deserve to know!!!!!

  28. Okay, BIG props to the folks last night who were predicting Chicken Soup as the next to go.

    So who’s next?

    If it helps (who knows), I had mega-bloodwork done yesterday on one of my cats, who’s been eating Hill’s dry k/d till 10/06, then Hill’s science Diet Hairball light (dry) plus a little extra Blue Seal (By Nature Organics Chicken) thrown in.

    Her kidneys are 100% okay. The rest, not so much - she has heartworm, which is a BIG problem we’re trying to figure out how to deal with - but as far as the food goes, all seems okay. And we buy food frequently, so if there were a problem with those, she’d be a good indicator.

    So I’m guessing it isn’t Hill’s or Blue Seal.

    Substituting an ingredient like that is just plain underhanded and makes me mad on so many levels.

    Two things of interest…

    If ChemNutra has fully complied, then why the need for a search warrant? Or was that just a formality to cover the FDA’s butt.

    And now there is suggestion by ChemNutra of additional contaminated wheat gluten that did not come from them?

    What a farce this is.

    THANKS to Gina, Christi, and the whole crew here at PC.

    Your posts yesterday intrigued me enough to look into Dr. Jim Martin’s work at Cornell on feline heartworms. And that prodded me to ask for a heartworm screening for my cat later yesterday morning when I had a checkup appt. for her.

    Long story short, she has heartworm. BAD deal. But it seems as though we may have caught it early, which increases her chances of surviving it. I would NEVER have thought to ask for the test if I hadn’t read your post here, and my vet didn’t suggest it, either, since my cat is a strictly indoor cat.
    (Imagine my horrified surprise to learn that more than a quarter of cat heartworm cases are in kitties who never go outside. :( It’s nowhere near as rare as I thought.)

    Anyway, this is a roundabout way of saying thanks for all the work you do here. I don’t know if my cat will survive - but I know her odds would have been worse if it hadn’t been for this site. I can’t tell you how thankful I am for that.

    “To put it bluntly, I am glad that this is being written about. However, when, when WHEN, is the news media going to get the count right. The “16” reported in the article above represents the number of ANIMAL SPECIMENS THE FDA EXAMINED. They stopped examining at that point and started chasing the imports. There are quite likely in excess of 4,000 dead animals and probably another 10,000 sick animals, to be on the conservative side. PLEASE, news media - if you’re going to report 16, at least clarify that the FDA stopped examining at this point.”

    Do you use rye or barley gluten meal?

    No.

    Do you use whey protein isolate?

    No.

    So I’m guessing besides what we’re already seeing recalls for these “new” glutens may be suspect in pet foods. They are also answering that all their corn gluten doesn’t come from China and has been tested.

    —OK, now for something potentially interesting. Apparently, cyanuric acid reacts with
    melamine. I just noticed this on an internet search but haven’t heard anything in the
    news about any potential link between this reaction and the sick pets. What happens
    when the two chemicals of melamine and cyanuric acid combine and how poisonous might
    the process or final product be? I hope someone is looking into this.:

    “Testing for cyanuric acid is most commonly done with a turbidometric test, which uses a
    test reagent to precipitate the cyanuric acid and then uses the relative cloudiness
    (turbidity) of the reacted sample to gauge the CYA concentration.

    A reagent called melamine is used. The melamine combines with the cyanuric acid in the
    water to form a fine, insoluble, white precipitate that causes the water to cloud in
    proportion to the amount of cyanuric acid in it. When the water clouds, it becomes more
    difficult to see an object in it.”

    BEIJING — China said Thursday it has banned melamine from food products after the chemical was found in exports of vegetable protein shipped to the United States but rejected it as the cause of dozens of pet deaths in North America.
    U.S. Food and Drug Administration officials say they suspect the substance, which is a chemical found in plastics and pesticides, is to blame.
    China’s Foreign Ministry said in a statement there was no evidence to support the FDA’s claim but that it would cooperate with the United States to find out what actually killed the animals.
    The comments in a statement released by the Chinese Foreign Ministry were the first detailed response from Beijing to concerns that emerged a month ago about the country’s wheat and rice gluten exports.
    China has said it was investigating the issue but had not acknowledged until Thursday that Chinese companies had shipped gluten tainted with melamine to the United States.
    The ministry said the contaminated vegetable protein managed to get past customs without inspection because it had not been declared for use in pet food.
    “At present, there is no clear evidence showing that melamine is the direct cause of the poisoning or death of the pets,” the statement said. “China is willing to strengthen cooperation with the U.S. side … to find out the real cause leading to the pet deaths in order to protect the health of the pets of the two countries.”
    U.S. Food and Drug Administration officials have said they suspect Chinese wheat and rice gluten laced with melamine and added to pet food may have killed at least 15 cats and dogs. The chemical appears to have caused acute kidney failure in animals that have died or been sickened after eating foods contaminated with the chemical.
    China said an investigation triggered by FDA complaints found melamine in wheat and rice gluten exported to the United States by two Chinese companies: Xuzhou Anying Bio-technology Development Company and Binzhou Futian Bio-technology Company.
    The case has prompted China to step up inspections of plant-based proteins and to list melamine as a banned substance for food exports and domestic sales, it said.
    China also invited FDA officials to visit China to help with further investigations into the case and to consult on improving inspection techniques, it said.

  60. Bryant brought up a good point last night. I had told him about the media lady’s post about the producers not wanting to air anything on the pet food recall. And, to keep sending our emails.

    He said the reason the media isn’t carrying it is because of the clients advertising (dog & cat food commercials).

    I remember when TV was a service to the people. PBS recently had a segment on how the media has changed. Well, since they are such a poor service to the American public — maybe they should only air at that company’s business…24/7.

    In a way, that’s a violation of FCC, I believe. If not, it should be. That is biased media — not fair & balanced. A few of the newpaper journalists are finally getting some good info.

    I let ‘em have it all the time. But, now that they’ve kept silent for so long they barely know what they’re talking about, ie: CBS has a link to Menu the other day for the complete recall list. As soon as I saw it I wrote to them & told them — in case they hadn’t heard — that other manufacturer’s foods had been recalled, as well.

    On April 16, the FDA announced that a quantity of rice protein concentrate also was subject to melamine contamination.     Now is the time to pull up your death and illness records and make a clone. Delete the names and addresses and any sensitive information; leave in the city, state, etc. Once cleaned up and any duplicate entries deleted, email the new file to all the AP reporters, major broadcast stations, etc.
    I believe that once they see documentation they will start thinking bigger numbers.

  68. There’s a corporation in Australia that is buying up newspaper companies & toll roads, in the US. I’ve forgotten their name. I think I remember, put need to check before I post.

    We have a Trans-Texas Corridor planned & they’ve been buying newspapers & curtailing the news about it. I had heard that they were doing that, so I checked it out myself. I found one small town newpaper that had a Google Search Engine & entered “TransTexas Corridor” — 0 came up within the site. I clicked to check on the web & like 14,000 links. This down is up in one of the areas, so that is quite suspicious.

    They bought the IN Toll Roads too. Plus, one in Chicago.

    Was Purina using all the money and pull they had to put out the info?

    Did Purina EVER say “We don”t care what brand you feed your pets, this is very important information and pet parents need to know that if their pet is drinking too much water or vomiting or becoming lethargic you need to get them to a vet. Pets are dying , no one knows why, and by the way that 16 “official’ deaths is a crock.”

    Did I miss that?

    Now Purina makes something that has cost me a ton of money and may have killed my dog, so I wasn’t just dancing happy with them anyway.
    Trying to be fair here.
    But there is no need at all for them to try and blow a bunch of PR cowflop around at this late date and expect me to swallow it!

    I have said it before and I am saying it now, if any company did not get a shiny face out front saying what needed to be said , getting out the info to the pet parents that needed it so desperately for soooo long, then they can kiss my lily white.

    All you need to know about ANY pet food company is where they were when the pets were dying.
    Were they covering butt or helping out?
    So far the score is, butts -all help-0

    I can’t imagine why companies didn’t come forward and say don’t use this or that until we can verify it’s safe and give info on what to do/watch for if your pets had eaten what they were concerned about. I understand for the companies that may have been blind sided, but they also should have triple checked with the contracted plants. and gotten it in writing apparently.

    NB started out doing the right thing by pulling all venison and not worring about code stamps, but still fell short. Blue Buffalo just yanked everything and dropped AN, which makes a pretty clear statement and more of what should have been done upfront by ALL the early ones.

    while i may not have used pet foods from some of the larger companies, they have also lost my biz on their other divisions. this has been going on far longer than anyone will ever admit and i will not risk my pets or my health. period.

    now, can someone PLEASE stop this thunder storm so my dog can stop shaking and i can go to bed?! PLEASE!!!

  77. The only dry food I’m still feeding is Canidae/Felidae. I made a choice to not buy anything made by Menu Foods, Diamond, or American Nutrition about 2 weeks ago. So far I feel as safe as possible feeding Canidae. Although, they said their food was not made by MF or Diamond, they would NOT tell me the plant it was made at, but did say it was made in Texas. Canidae also says on their website and by phone that they don’t use any glutens or proteins at all. At this point I am trusting them because as far as I know they have never had a recall of any sort. I hope and pray they are telling me the truth. After what Natural Balance did I will NEVER trust them again!!! If any one knows anything more about CANIDAE please, please let me know. I am trying to do the best I can with what I know, but it is sooo hard with these increasing recalls!!!

    I am not happy about this at all, brands that were supposedly “safe” are now being recalled in droves.

    I have been feeding Innova EVO with no problems, but once the supply that I do have runs out I will be preparing foods for my dog and 3 kittys. I refuse to contribute another penny to these murderers and thieves.

    I am going to get the groceries today as well as the supplemnts needed, I will start getting them used to the food tomorrw as I can see this not comming to an end.

    The pet food industry has let us down like no other, our government can’t be trusted to make them do th3e safe thing, so poooooey on it all.

    I might add I think it’s time ALL pet parents ban together and bring every single pet food company and manufacture up on criminal charges!!

    Fraud is a good starter, false advertising, along with cruelty even resulting in death..

  91. I can’t believe this. When I was trying to find something my cat with Chronic Renal Failure would eat I bought Blue Buffalo’s Spa Selects because it didn’t list any of the crap in the recall. This is making me cry. I have been fighting for almost a year and a half to keep her alive and ANI could have killed her and my other three cats with their stupidity. Thank God when I saw the recall of their kitten food I stopped feeding any of the Spa Selects to my cats. So help me God if that food set her progress back. I live with enough guilt that she has the disease in the first place never mind if something I fed her hurt her.

    That’s it we are sticking with baby food to give Porsche her meds. When will this nightmare end???

To anyone still hesitating on switching to home cooking for their dogs - we made the switch just a few weeks back strictly out of fear - honestly did not expect to see any changes in our dogs because we always fed the so called super premium foods (pause to bang head on desk). However, we are suprised and thrilled to see that our older dog is far more alert and active than he has been in years. We are using the Pitcairn book for guidance. Once you get a system worked out it is not difficult (had a bit of difficulty tracking down a couple ingredients for the supplements to add to the food). Home cooking gets my vote - no way will we ever go back to commercially prepared food. Even our dog biscuits are baked at home now.

  100. What a mess - importers blame their suppliers, manufacturers blame their importers, marketing companies blame the manufacturers - where does the buck stop? And on top of this we have manufacturers using ingredients that are not in the marketers specifications!

    I have to give Blue Buff credit - at least they pulled everything - which is more than most companies can say. And they also state that they are going to find another manufacterer for their food. I think it was Natura (Innova) who has some wet food made by MF say they were also going to find another manufactuerer.

    So - what about Wellness that has some of their foods made by MF, or Natural Balance which has foods made by ANI? Are they going to move their production? Can they really be sure that their products have been formulated to their ‘special’ standards.

    I think its time for the ‘good guys’ who have gotten caught in this mess to get together and build their own plant - complete with inspections and certifications that every run is made to the standards set by the marketers and has been tested for adulteration. It would be a start.

    I keep wondering when the FDA will search MENU FOODS. I want to know the TRUTH. When did Menu Foods FIRST suspect a problem with their products? How many of our pets could have been saved if Menu Foods had ordered a recall while they investigated? When did IAMS’s internal test first find a problem with their products? When did IAMS first contact Menu Foods? Was Menu Foods trying to use up their inventory without telling us?

    Apparently Menu Foods had no intention of ordering a recall until Iams forced them to.

    WHAT ABOUT THE CRIMINAL CHARGES FOR ANIMAL CRUELTY, FRAUD, AND INSIDER TRADING????????

    9 LIVES CANNED FOOD

    My cat ate 9 Lives all his life and used to vomit every week to 10 days consistently, sometimes even more frequently. I kept bringing up the vomiting issue to my former vet, and the vet said her own cat was a “vomiter” and ate plants and plastic to vomit — same as mine.

    The vet said he just was a vomiter and didn’t seem concerned at all. My cat also started drinking a lot of water in the winter, which he never did much of before, going to the dog’s water bowl quite a few times per day for several weeks. I was glad to see him drinking.

    Since I’ve switched to Solid Gold canned tuna, the cat has not vomited AT ALL since before Mar. 30th, so we’re coming upon a full month here. I do not like that the SG tuna is canned in Thailand and most likely comes from off shore there.

    I’ve completely stopped the dry food because I read a vet’s paper online that said dry food does not have enough moisture in for cats with kidney problems. The Solid Gold just has the tuna, water for processing, and the vitamins/suppplements (I hope).

    I’m looking for a lower protein food, but even the research is contradictory there. Some vets feel that lower protein foods may not help the kidneys as much as older research thought. My goal right now is to give the cat as pure a protein food as possible with the right vitamins & minerals and NO grains, glutens, meals, etc.

    Before switching, my cat stayed in bed all day and only came out to eat. Even his fur, long hair, was somewhat clumped, although not matted. I attributed it to his getting older (12) and not grooming as much, but now he’s coming out to socialize and is chasing his “mouse” on the fishing pole and following me from room to room. He’s not drinking from the dogs’ bowl, although I mix water with his canned food, which I always did. His fur seems silkier, too. I think there has been quite a positive change in him just from the food. He had a little fluid therapy, which we have now stopped.

    I totally agree and my poor kitty Lil Bear would also agree about the 9 lives wet food also, if he were still alive to do so….and they still refuse to even answer emails now!

  104. Has anyone checked the Northern California Save-Mart NuPet brand? They have small cans that are clones of Fancy Feast. I use their cubed beef dinner as a cat treat and a dressing to get my cats to eat home-cooked beef. The can does not list any kind of glutin as an ingredient.

    Also, Costco/Kirkland has recalled canned dog food, but what about the Signature Cat Maintenance dry kibble?

    So far Athena and Danny are fine, and I want to keep them that way.

    The city may be looking for a few good noses. When it meets Tuesday, the City Council is expected to set a public hearing for a law that would create a committee to sniff out objectionable odors.

    Ogden’s chief administrator, John Patterson, said the city is not singling out a specific company for enforcement. But there have been complaints about a pet-food factory, American Nutrition Inc.

    Despite promises, American Nutrition has failed to install an exhaust scrubber on three ovens that bake treats for dogs and cats, Patterson said.

    “Stench is not the lasting memory that we want people to have in Ogden,” he said.

    Councilwoman Dorrene Jeske said an ordinance is overdue.

    “The odor from the American Nutrition plant may have hindered us from getting some businesses along Wall Avenue,” she said.

    Company executive Bill Behnken was away from his office Monday and unavailable for comment.

    American Nutrition last year said it had installed scrubbers on equipment used to produce kibble products from a mix of corn, wheat, rice meal and meat products, the Standard-Examiner reported.

    In addition to creating a sniff patrol, the ordinance would also require companies to adopt technology or change practices to reduce or eliminate bad odors. Violators would be fined $125 to $500.

    A panel consisting of a city building official and three residents appointed by Mayor Matthew Godfrey would investigate complaints.

    A device known as an olfactometer would be used by city inspectors to determine if an odor had reached an objectionable level. Restaurants and bakeries would be exempt.

I did research in Colorado for the nonsense with the Texas Toll Roads, which run by the Front Range and head up to Canada and found a huge Utah political connection behind the whole thing from Mexico to Canada. There are a global network of such roads planned. And they threw generational land owners off their land despite all the bluff of “over my dead body” and use of citizen weapons stockpiled, the ARMY kicked homeowners off… it already happened in 2004.

    They’re no stopping this juggernaut of greed and evil … quite frankly, I think the Pet Food Scandal is looking like some “flag” operation to test processes and responses in the US HUMAN food chain as well … how broken it is, and where it works (so they can do ???) … The only thing that works are the people and these blogs… the hidden identity of those five Baby Food companies that may have product be tainted by RPC … is a warning to the levels these people will stoop and not warn us. Biowarfare? Genocide anyone? Is it really out of the realm of possibility this Administration would let the unspeakable roll for money? Consider their origins.
